Terms of Service
These Terms of Service (“Terms”) form a binding agreement between you and Blaitware Limited (“Blaitware”, “we”, “us”) for access to and use of Bytstack and related services (the “Service”).
Effective date: 10 October 2026
1. Acceptance
By creating an account, accessing the dashboard, calling the API, or otherwise using Bytstack, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” includes that organisation and its workspace users.
Bytstack is a product brand of Blaitware Limited, a company registered in Nigeria. Registered address details are available on request via [email protected].
2. Eligibility and accounts
You must be at least 18 years old and capable of forming a binding contract under Nigerian law. You are responsible for the accuracy of registration information, for safeguarding credentials and API tokens, and for all activity under your account and workspaces, unless caused solely by our breach of these Terms.
Workspace owners and admins control membership and resources. You must promptly revoke access for people who should no longer use the workspace.
3. The Service
Bytstack is a platform for deploying and operating Node.js applications and related resources. Depending on your plan and configuration, features may include git-based builds and deploys, managed databases and caches, custom domains and TLS, preview environments, logs and metrics surfaces, CLI access, and team controls. For Nigerian companies and customers, the Service may host workloads in data centres in Abuja and Lagos, Nigeria, as described in our Privacy Policy.
We may modify, add, or discontinue features, impose fair-use or rate limits, and offer beta or preview functionality. Beta features are provided as-is and may change or be withdrawn. We do not guarantee uninterrupted or error-free operation, but we aim to keep the platform reliable and to communicate material outages where practical.
4. Acceptable use
You must not, and must not allow others to:
- violate applicable law, including Nigerian cybercrime, privacy, and IP laws;
- use the Service to distribute malware, conduct unauthorised intrusion, phishing, or denial-of-service attacks;
- interfere with or disrupt the Service or other customers’ workloads;
- attempt to bypass security, billing, or isolation controls, or probe systems except as expressly authorised in writing;
- host unlawful content, or content that infringes others’ rights, or that we reasonably determine is abusive or harmful to the platform;
- resell or white-label the Service except under a separate written agreement; or
- misrepresent your identity or affiliation when using the Service.
We may investigate suspected violations and suspend or terminate access as described in section 11.
5. Customer content and intellectual property
You retain ownership of code, data, and materials you submit to or run on the Service (“Customer Content”). You grant Blaitware a worldwide, non-exclusive licence to host, copy, transmit, and process Customer Content solely as needed to provide, secure, and support the Service, and to create de-identified operational metrics.
Blaitware and its licensors own the Service, software, documentation, brands (including Bytstack), and all related intellectual property. Except for the limited right to use the Service under these Terms, no rights are granted to you.
Feedback you provide may be used by us without obligation to you.
6. Data protection
Our processing of personal data as a controller is described in the Privacy Policy. For Customer Content that includes personal data of your end users or others, you are the data controller (or act for the controller) and Blaitware acts as a data processor. You warrant that you have a lawful basis and have provided required notices under the Nigeria Data Protection Act, 2023 and other applicable laws.
You must not use the Service to process special categories of personal data or children’s data in a manner that would impose obligations we have not expressly agreed to in writing.
7. Fees, taxes, and payment
Paid plans and usage-based charges are described in the product pricing or your order form. Fees are billed through our payment providers (such as Paystack or Stripe) in the currency shown at checkout. You authorise us and those providers to charge the payment method you provide.
Fees are exclusive of taxes unless stated otherwise. You are responsible for applicable taxes, including Nigerian Value Added Tax (VAT) where it applies. We may collect and remit VAT or other taxes as required by law.
Late or failed payment may result in suspension or restriction of paid features after notice (or sooner if fraud is suspected). Fees already paid are non-refundable except where required by law or expressly stated by us in writing.
8. Security and shared responsibility
We implement reasonable administrative, technical, and organisational measures to protect the Service. You are responsible for securing your applications, secrets, dependencies, access policies, and data you store in Customer Content. The Service is a shared responsibility model: platform controls do not replace secure coding and operational practice on your side.
9. Confidentiality
Each party may receive non-public information from the other (“Confidential Information”). The receiving party must protect it with reasonable care and use it only to perform under these Terms. Confidential Information does not include information that is or becomes public through no fault of the recipient, was already known without duty of confidence, or is independently developed.
10. Warranties and disclaimers
The Service is provided on an “as available” basis. To the fullest extent permitted by Nigerian law, Blaitware disclaims all warranties not expressly set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that Customer Content will never be lost; you should maintain independent backups of critical data.
11. Suspension, termination, and liability
You may stop using the Service and close your account at any time, subject to outstanding fees. We may suspend or terminate access if you materially breach these Terms, create risk to the platform or others, fail to pay, or if we are required to do so by law. We will give notice where reasonably practicable.
After termination, we may delete Customer Content after a commercially reasonable period (and sooner where required for security or legal compliance). Where feasible, we will allow export of Customer Content before deletion for a limited window; do not rely on us as your sole archive.
To the fullest extent permitted by Nigerian law, Blaitware’s aggregate liability arising out of or related to the Service or these Terms in any twelve-month period is limited to the fees you paid to Blaitware for the Service in that period (or, if none, one hundred US dollars or Naira equivalent). We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, even if advised of the possibility, except where such exclusion is prohibited by law (including liability for fraud or death/personal injury caused by negligence where such liability cannot be limited).
You will indemnify and hold Blaitware harmless from claims, losses, and expenses (including reasonable legal fees) arising from Customer Content, your use of the Service in breach of these Terms, or your violation of law or third-party rights.
12. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. The parties will first attempt in good faith to resolve disputes by contacting [email protected] (or the support channel we designate). If unresolved within thirty (30) days, exclusive jurisdiction lies with the courts of Nigeria, unless mandatory consumer protections require otherwise.
13. Changes
We may update these Terms by posting a revised version on this page and updating the effective date. Material changes will be communicated by email or in-product notice where appropriate. If you do not agree, you must stop using the Service. Continued use after the effective date constitutes acceptance of the updated Terms.
14. General
These Terms are the entire agreement between you and Blaitware regarding the Service and supersede prior terms on the same subject. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Provisions that by nature should survive termination will survive.
